Terms of service
The short version: we find companies that need what you sell, email them for you, and pass along the people who reply with interest. You only pay for those interested buyers. Your first 5 are free, there’s no setup fee and no contract, and you can flag any buyer within 7 days.
These terms are between you and Growtoro LLC (“Growtoro”, “we”). They cover our done-for-you outbound service. You accept them when you click “Approve and launch” in your client portal.
1. What we do
We build a campaign for your business: we find companies that fit what you sell, write emails to the right people there and send them on your behalf, then pass along the people who reply with interest. Nothing sends until you review and approve your campaign in the portal.
2. What counts as an interested buyer
An interested buyer is a person at a company we contacted who replies asking for pricing, a quote, samples, a line sheet, specs, a demo or a call, who asks to carry, stock or resell your product, or who otherwise asks to move forward with buying from you.
These never count:
- Auto-replies and out-of-office messages
- Unsubscribes, “not interested” and requests to stop
- Anyone at a company on your skip list
- The same person twice: each person counts once, however many times they reply
3. Pricing
You pay the price per interested buyer shown on your campaign review and in your portal. Your first 5 interested buyers are free, unless your portal shows a different number. There’s no setup fee, no monthly fee and no contract.
If we ever change your price, we’ll email you at least 14 days before. A new price only applies to buyers who arrive after it takes effect.
4. The 7-day flag window
If an interested buyer doesn’t look right, flag it in your portal within 7 days of when it arrived and it comes off your bill. No back and forth. Good reasons include: not a decision-maker, not actually interested, already a customer, outside the audience you approved, or a duplicate. If you flag a free buyer, the next buyer takes its free spot.
Flags are for buyers that genuinely don’t fit. If we see a pattern of flags on genuine interested buyers, we’ll talk to you about it, and we may end the service.
5. Billing
Billing runs every Friday. We charge the card on file for each interested buyer whose 7-day flag window has closed, with one line per buyer on your invoice. Every invoice is in your portal.
You add a card once your free buyers are in. Your campaign keeps sending for 3 days while you add one, then pauses until you do. Before a card is on file, a campaign can also send a limited trial volume of emails, and it pauses if it reaches that limit.
If a payment doesn’t go through, your campaign pauses until you update your card. Buyers who already arrived are still owed. Cards are handled by Stripe; we never see or store your full card number.
6. Your monthly cap
You choose a monthly cap on interested buyers. When you reach it, your campaign pauses until the 1st of the next month. Anyone who replies with interest after you hit your cap (from emails that already went out) is free. You can change your cap anytime in your portal.
7. Pausing and cancelling
You can pause your campaign anytime from your portal and restart it the same way. To cancel, email us at support@growtoro.com. Cancelling stops all sending. Interested buyers who arrived before you cancelled are billed as usual once their flag window closes.
8. Your part
- Tell us accurately what you sell and who you want to reach.
- Review your campaign before it launches. You approve the audience, the sender name and the style of the emails.
- You authorize us to send emails and replies on your behalf under the sender name you approve. Don’t ask us to make claims that aren’t true.
- Follow up with the buyers we pass along. What happens after that is between you and them.
9. How we send
We send in line with the CAN-SPAM Act: every email is honest about who it’s from and what it’s about, and every opt-out is honored and kept on a do-not-contact list. Each email is written for the person receiving it, so emails vary within the style you approve.
10. No guarantee of results
We work hard to bring you interested buyers, but we can’t promise a number of buyers, meetings or sales. That’s why you only pay for buyers who actually raise their hand.
11. Buyer information
We share each interested buyer’s contact details and conversation with you so you can follow up. Use them only to follow up about your products, and in line with the law.
12. When we can end the service
We may stop your campaign if you ask us to send something misleading or unlawful, if payments keep failing, or if we can’t run your campaign responsibly. We’ll tell you why by email.
13. Limitation of liability
Our total liability under these terms is limited to what you paid Growtoro in the 90 days before the claim. We’re not liable for indirect or consequential damages or lost profits.
14. Changes to these terms
We may update these terms. We’ll email you at least 14 days before a material change takes effect. The version you accepted is recorded on your account.
15. Governing law
These terms are governed by the laws of the State of Delaware, where Growtoro LLC is registered. Any disputes will be resolved in the state or federal courts located in Delaware.
